Visitors, Regular Members, Contributing Members, and other Users of Policy Futures Network (“Users”), including this website and any other PFN Service, are solely responsible for their use and for the direct and indirect consequences of their use of PFN content, third-party content, and any PFN Service, and for complying with all PFN rules and all applicable laws.

Users must register with PFN to access certain PFN Services. Among other things, each User must register using his or her real name, email address, phone number, and other personal information. Users who use PFN Services to access, collect, or use personal information of other Users agree to do so in compliance with all applicable laws. In addition, Users agree not to sell any personal or other information accessed through PFN Services. Users who provide PFN with any personal information of their own or of others represent and warrant that the personal information has been lawfully collected and provided and that PFN’s use of such personal information will not violate or infringe on the rights of any others or violate any applicable laws.

All PFN Services are protected by copyright, trademark, and other US, foreign, and international laws. These terms do not grant any User, including any Member, any right, title, or interest in PFN Services; content on the PFN Services; or PFN trademarks, logos, or other features.

Users who submit, post, or display content on or through PFN Services retain their pre-existing rights to such content. PFN does not require an exclusive right to content published on or accessible via any PFN Service. If a User submits, posts, or displays any content on or through any PFN Service, the User grants PFN a non-exclusive, royalty-free, worldwide, fully paid, and sublicensable license to use such content on any PFN Service. PFN will respect the content copyright and ownership rights of others.

PFN retains the right to suggest edits and other modifications to submitted content (for approval by the author(s)) and to approve or disapprove the ultimate publication and continued availability of content on any PFN Service.

PFN may review a User’s conduct and content for compliance with PFN rules and terms, and PFN reserves the right to delete, remove, or disable any such content and any content alleged to infringe on the rights of any others (including copyright infringement). In addition, PFN may terminate the access, subscription, membership, and other PFN rights of any User for failure to comply (with or without notice).

PFN wants to address any concerns without needing a formal legal case. Before filing a claim against PFN, a User agrees to contact PFN and to attempt to resolve the claim informally by sending a written notice of the claim to policy.futures@policyfutures.net or by certified mail addressed to Policy Futures Network, 2021 L Street, NW, Suite 101-274, Washington, DC 20036.

Users agree that any dispute with PFN will be resolved solely through individual action and will not be brought as a class arbitration, class action, or any other type of representative proceeding. Also, Users waive all rights to resolve any dispute relating to PFN in court (whether by jury trial or otherwise); all disputes will be resolved through confidential, binding arbitration proceedings before one arbitrator in Washington, DC. Users agree that any disputes that arise between the users and PFN will be governed by Washington, DC law.

Each User agrees, to the fullest extent permitted by applicable law, to indemnify, defend, and hold harmless PFN, including PFN officers, partners, contractors, directors, agents, and employees, from and against any losses, liabilities, claims, demands, damages, expenses, and costs arising out of or related to the User’s violation, misappropriation, or infringement of any rights of another or the User’s violation of any law. Of course, PFN does not exclude or limit PFN liability where it would be illegal to do so. In any case, PFN shall be responsible to any other person only for losses and damages that are a reasonably foreseeable result of PFN’s failure to use reasonable care and skill or PFN’s breach of contract. And to the extent that such a limitation is permissible, PFN’s responsibility and liability shall not exceed the greater of $100 (US) or the amount paid to PFN by the User or other claimant for access to and use of PFN Services.

PFN reserves, in its sole discretion, the right to make any changes (including terminating) any PFN Service, PFN feature, PFN rules, Terms of Service, Privacy Policy, and other PFN provisions and features from time to time.
